We have NO REMEDY!
Since we CANNOT file an Article 78 against the DEC

because the NY State Courts are closed

- The DEC LIED when they said there was "no material conflict with local zoning". (Negative Dec)
This is because a Hazardous Waste Incinerator is not a permitted land use under
Village of Endicott Zoning law.
- The DEC LIED when they said "a coordinated review was performed". (Notice of Completed Application)
- The DEC LIED when they said this was an "unlisted SEQR action". (Notice of Completed Application
Because this requires a Zoning Change, this MUST BE a Type-1 SEQR action,
which requires public hearings AND a full Environmental Impact Statement!
The two DEC administrators who signed these documents:
- Joseph Dluglolenski (Negative Dec, Notice of Completed Application)
- Scott E. Sheeley (signed the permit)
... seem to be guilty of NY Penal Law § 170.10 Forgery in the second degree
A person is guilty of forgery in the second degree when,
with intent to defraud, deceive or injure another, he falsely makes,
completes or alters a written instrument which is or purports to be,
or which is calculated to become or to represent if completed:
3. A written instrument officially issued or created by a public office,
public servant or governmental instrumentality; or
Forgery in the second degree is a class D felony.
Joseph Dlugolenski cannot claim ignorance, because I made him aware of these issues
in my comments to DEC on the permit app.
How does the Village of Endicott respond?
Will they SUE the DEC w/an Art 78
for VIOLATING our Local Zoning Laws?
and for Violating SEQRA?
for VIOLATING our Local Zoning Laws?
and for Violating SEQRA?
and thus ENDANGERING the Health, Safety, and Well-being
if the Residents of the Village?
NO!
The Village Board just voted on Mon. to move forward to
CHANGE THE ZONING LAW!
and Ordered a Coordinated Review

when the meetings are CLOSED to the Public
when the meetings are CLOSED to the Public
and NY Open Meetings Law is SUSPENDED
by Executive Order of Gov. Cuomo
I would expect some RESISTANCE from the VoE board
to the ILLEGAL ACTIONS by Cuomo's DEC.
Instead, they get out the GREASE.
WHY is the VoE board covering for the CRIMES of the DEC?
... instead of PROTECTING the CITIZENS who live in the Village
and DEFENDING our LOCAL LAWS?
