5/17/2020 PSB Guest Viewpoint: Battery Recycling Plant

Battery recycling part of building green economy

Your Turn

Linda Jackson and Cheryl Chapman Guest columnist

In September of 2018, Empire State Development (ESD) announced that a battery recycling facility would be locating in the Village of Endicott, as part of a green jobs initiative.

ESD had recruited SungEel HiTech to Endicott to work with Binghamton University's battery research team, headed up by Nobel laureate Stanley Whittingham, and iMperium3, the new battery manufacturing plant going into Huron Campus.

We were not initially in favor of this project, having heard about the potential negative impacts on the environment. After everything the village has been through over the years, the last thing we wanted was to risk the health and safety of village residents. But we decided to do our homework and to get all of the facts and data we could.

We attended workshops, public meetings and reviewed numerous documents from the Department of Environmental Conservation (DEC). We participated in the public comment process and met with state elected leaders,

county officials, and representatives of ESD, DEC and SungEel. We learned that the plant did not even need to receive a state facility permit to operate because of the low air emissions projected, but the DEC took that extra step. Information about their thorough findings can be found on the village website, endicottny.com.

The vote taken last Thursday by the board has NO impact on whether the battery recycling facility will be allowed to operate in the Village of Endicott. The DEC has already issued a state facility permit.

This zoning code change was meant to clarify and add restrictions to protect the village, for all current and future recycling facilities that intend to operate in our Industrial Zone. There is currently a petition circulating in an attempt to revisit the passage of Thursday's zoning change; the only thing this petition, and the misinformed group behind it, can accomplish is to defeat the additional protections we are putting in place.

This continues to be viewed favorably by all of the partners. There was nothing controversial about this when it was announced, nor through the DEC review process. According Dr. Whittingham, "the recycling of lithium batteries is critical to a sustainable world. Responsible battery recycling will help to minimize fires such as what recently occurred in Apalachin, and reduce disposal in county dumps. SungEel's approach to recycling is what we would describe as brute force — they

turn all the metals in a metal rich ore that will go to the powder manufacturers for future use. It is a sound approach that DEC has approved."

Dr. Shailesh Upreti, chairman and director of iMperium3, added, "in order for us to convert Endicott into a next generation manufacturing hub and a community of green visionaries, we must support companies that are bringing cutting edge processes to this region."

We agree with these distinguished scientists and are proud to be a part of building a new green economy in Endicott.

Sungeel Endicott Incinerator: My thoughts on the PFAS "setback"

https://youtu.be/BynUJ4kKs9M

Briefly: If we choose to play in an arena where we have no agency, then we are fools.

When presented with a rigged game, we shouldn't play, just because it's the only game in town, and this is the only hoop we've been provided to jump through.

When presented with a rigged game,
We must turn the tables upside down.

apologies for the mixed metaphor ;)

BREAKING NEWS: NYSDEC Reopens Permit for Sungeel Hazardous Waste Incinerator in Endicott

----------- FOR IMMEDIATE RELEASE -----------------

By William Huston
for Concerned Citizens of Endicott

NYSDEC is reopening the comment period on the Sungeel ASF permit
for the Lithium Ion Hazardous Waste Incinerator in Endicott, due to the
suspected presence of PFAS compounds.

NYSDEC will make permit modifications, and reopen the public comment
period ONLY ON THESE CHANGES.

William Huston of Concerned Citizens of Endicott states:

This is great, as it will cause a delay in the permitting process!

However, the NYSDEC has failed to identify the numerous other
defects Concerned Citizens of Endicott  have identified with this permit,
the biggest being the initial mis-classification as an Unlisted SEQR Action.

This project MUST BE a Type-1 SEQR, due to a necessary zoning change
impacting > 25 acres. 6 NYCRR 617.4(b)(2).

Also, because NYSDEC failed to identify just ONE of many possible impacts
to the environment and/or human health, NYSDEC failed to correctly
issue a Positive Declaration, and begin the EIS process.

Because of this initial misclassification, and erroneous "Negative Declaration",
the NYSEC FAILED to hold public hearings, FAILED to perform an EIS, and FAILED
to perform a Coordinated Review.

The NYSDEC MUST START OVER, classify this correctly as a Type-1 SEQR,
perform a COMPREHENSIVE EIS, a COMPREHENSIVE Coordinated Review,
and also hold multiple public hearings, beginning with SCOPING. (+DEIS, FEIS, & Permit).

Hello from Endicott! (Letter to Danish Mir, SMCC Americas)

To: Danish Mir, Glendon Archer
(CC: Donna Lupardo, Fred Akshar, Jason Garner, T. Fucillo, ESD Corp)

Hi Guys,

Just a quick heads up....
This is really looking bad for you all.

We have thousands of people engaged on
this issue. I've never seen anything like this
level of community involvement from this little village in 20 years of living here.

Wait until you see the press conference tomorrow!

Equal in size with Community Engagement
is also the size of this procedural clusterf#k.

Everything was done wrong here.

This should have been a Type-1 SEQR
DUE TO A REQUIRED ZONING CHANGE
affecting > 25 acres.

This almost certainly guarantees us
a) DEC Public Hearings and b) an EIS

MANY LAWS were violated here.

Several village officials are acting in a very bizarre fashion,
including the Village Attorney.

There are MANY examples of the Mayor making
OUTRAGEOUS false statements to the press, and to the public in emails and on social media:

There is strong evidence of Political Corruption.
We have the roster of the meetings.

We've got many of the emails (see attached).
I know the AG is looking into this.

I believe someone is reaching out to the
Federal Prosecutor based at NDNY.

Everyone knows where this investigation will lead. ESD and the Governor's Mansion.

Our BASIC DEMANDS has been from the beginning

1) A comprehensive EIS, including an economic study,  traffic study, road use agreement, health study,
2) COMPREHENSIVE BASELINE Ambient Air Study
3) A full Type-1 SEQR as is required by law due to a required zoning change > 25 acres.
4) Multiple DEC public hearings at every stage (Scoping, DEIS, FEIS, Permit).
5) FOLLOW THE DAMN LAW!

If you do not agree to FOLLOWING NEW YORK
ENVIRONMENTAL CONSERVATION LAW and
ENDICOTT VILLAGE LOCAL LAWS,

then you should have a LOT of money set aside
for the legal fight. Because there are multiple
lawsuits coming.

You should have a LOT of money set aside for Public Relations,
because you have a PR Disaster on your hands.

Next to baseball fields?
C'mon.

During a Pandemic?
You have got to be kidding me.

People on the planning calls sometimes
get the giggles! This is so ridiculous.

Your position is untenable.
You cannot win here.

I have been involved in many environmental campaigns, and many winning campaigns: Constitution Pipeline, LPG storage at Seneca Lake, Fracking in NY, and others.

We have defeated billion-dollar projects from companies with hundreds of billions in market cap.

I have almost never seen a defeat where there is
strong community engagement, like we have here.

There is a Nonviolent Direct Action Group forming, which has had very constructive conversations with Endicott Police Chief Pat Garey about the rules of engagement for First Amendment Actions, which may include (at some point) arrestable actions.

We are FIERCE environmental fighters here in NY.

Let's recall  We Are Seneca Lake from just a few years ago: where 600 people were arrested doing blockades of an industrial facility ...until they withdrew their application.

Let's recall "My Name is Allegany County" from the 1990 where a small, rural community defeated a low-level nuclear
waste dump.

People here in the Binghamton-area defeated a toxic trash incinerator in the 1980s.

Please be smart and withdraw your application now.

Please consider another location for your Toxic
Hazardous Waste Incinerator.

Thank you,
William Huston,

Sungeel Mechanic's Lien (!!)

Demolition Contract "M Cristo Inc" did $800k of demolition work inside Bldg 259 last year.

Of course, this is a big problem since the DEC hadn't issued a permit until 3/30/2020, and according to Village Attorney Bob McKertich on the Zoom MTG last night,  Sungeel STILL has not applied for a building permit.

Sungeel paid $250k, and stiffed them for $550k. Mech's Lien filed 12/30/2019.

See attached.

Credit to Citizen Journalist John Solak for finding this.

M Cristo was found guilty of violating the Clean Air Act and falsifying a federal document in July 2018.

XNG Manheim Station appears to be shuttered.

The last I heard from one of my whistleblower sources was
that XNG was scaling back their injections into the Iroquois pipeline.

And he even told me that IGT "doesn't want our gas", but didn't explain why.
Not enough demand down state? Low quality gas? (no typical processing
seen at Forest Lake, like we see before injection onto interstate transmission--
dehydration, slug removal, h2s removal, etc).

Today I got two similar reports (may have originated from the same person) which said:

"My friend reliably informed me today that a guy who works at XNG told the
guy who was working on his car that his XNG job is over & so are they!

The gates are closed & no activity has been seen.

Of course, John Haughton, the town board supervisor claimed it was only temporary because if the Covid virus.

And gas prices may be too competitive now. I'll keep you updated!"

I am happy to say where this report comes from,
but I am in the habit of protecting my sources.

I hear from Vera Scroggins something similar.
Forest Lake has MANY idled tractors parked, and just a few trucks rolling
out, evidently to core-customers and not "pipe-to-pipe".

PS: XNG had another rollover accident, this one in Washington State:

A police officer posted on Twitter that the truck was "hauling an empty propane tank".
I responded respectfully that the Washington State PD should get better trained on these
experimental vehicles.

I hope you all are well.

EASY action: Sign the Petition against the Endicott Battery Incinerator!

1) Please sign the Petition!
It's only been live for a couple of days and already has over 800 signatures!
http://NoBurnBroome.com/
WE DON'T HAVE MUCH TIME!
The vote on the Zoning Change is scheduled for Monday May 4th!

2) If you live, work, or shop in Endicott or downwind
(Vestal, Union, JC, Binghamton), then PLEASE
call or email the Village Trustees and Mayor and say

PLEASE DO NOT CHANGE THE ZONING TO PERMIT
THE HAZARDOUS eWASTE INCINERATOR IN ENDICOTT

    Contact info here: https://endicottny.com/local-government/mayor-village-board/

3) Call Bob Joseph @ WNBF Monday morning:   9:10am to 11:30am     607-772-1290

4) Write a letter to the Editor. Keep it under 200 words:

5) ATTEND the Virtual Public Hearing Mar 4th!
Watch the Village of Endicott website
or their Facebook page for the link to the Zoom
"virtual public hearing": RAISE YOUR VOICE!!

Thank you!

BULLET POINTS FOR YOUR COMMENTS:
  • Minimal Environmental Review:
  • NO Environmental Impact Statement!
  • No Emergency
  • No Public Hearing!
  • DEC said a "Coordinated Review" was done in October 2019.(It was just completed Apr. 17th 2020!)
  • DEC said there was "no identified hazard to human health"
despite there are many known toxic contaminants, including
    at least 3 known carcinogens.
  • DEC air models based on a single test result.
NO BURN BROOME Science Advisor Dr. Paul Connett says
this is bad, as the readings can vary 1000x over a single day!
  • NO BENEFIT for Endicott!
This company will pay NO LOCAL PROPERTY TAXES
(as they are just a tenant of Huron Campus).
Just a handful, of dirty, dangerous, low-wage jobs.

  • Mayor Linda Jackson and Trustee Cheryl Chapman
    were against the project
    but CHANGED THEIR MINDS
    after being pressured
by a bunch of powerful local
politicians: Donna Lupardo, Jason Garner, Fred Akshar,
and the Empire State Development Corporation.

This was done during CLOSED-DOOR session where the public were
excluded, and alternative perspectives could not be presented.
  • This is being rushed through DURING A 100 YEAR PANDEMIC,
and while the courts are closed (no remedy!)
  • This zoning change will expose the village to an expensive lawsuit.

URGENT REQUEST: Please call the NY AG's office TODAY and MONDAY!

 VERY URGENT REQUEST!!

Ask them kindly to MAKE AN INTERVENTION in the Endicott Battery Incinerator Permit Proceeding, set to end on Monday at the Village Offices.

1) The DEC Permit is illegal and fraudulent. It GROSSLY violates SEQRA and the rights and dignity of the PEOPLE who live in the Village of Endicott. It CANNOT BE an Unlisted SEQR action, and it MUST BE a Type-1 SEQR due to a change in a zoning impacting > 25 acres. (6 NYCRR §617.4(b)(2)) We DEMAND an Environmental Impact Statement and a Public Hearing, and a PROPER GML 239 review!!!

2) We have NO REMEDY while the courts are closed!

3) This REEKS of political corruption. Two village officials were PRESSURED in a series of meetings (2/28/2020, 3/10/2020) with Fred Akshar, Donna Lupardo, Chris Pelto, Sungeel and their hired attorney and engineers, Jason Garnar, and a heavy presence with reps from Governor Andrew Cuomo's Empire State Development Corp, which made an overt threat: APPROVE THIS or else put these other development projects in jeopardy.

THIS IS MAFIA STYLE BULLYING & INFLUENCE PEDDLING!
THIS LOOKS LIKE ORGANIZED CRIME TO ME!

This looks like a CONSPIRACY of Government Officials, State Actors
acting under Color of Law, to VIOLATE the CIVIL LAWS of the State of NY,
and the Village of Endicott, and create a general Hazard to Public Safety
and Public Health.

We have one of the meetings on tape, where an overt threat came from
Empire State Development Corp. reps.

4) And this is being SHOVED DOWN OUR THROATS during a 100 year Pandemic / Martial Law.

5) We have a winning case, and are prepared to sue the State of NY.
The AG will have to defend this clusterfr#ck.
If this goes through, this will be a huge embarrassment to the Governor and
    everyone involved.

6) There is a substantial group of community leaders and ordinary citizens who formed No Burn Broome. Our petition has been online for around 4 days, and has over 1,400 signatures.

We ARE NOT STOPPING until this project is PAUSED,
and we get an ENVIRONMENTAL IMPACT STATEMENT and a proper DEC PUBLIC HEARING, customary for a Type-1 SEQR review, which is REQUIRED BY LAW, due to a zoning change greater than 25 acres (560 acres).

7) The Mayor is continuously making OUTRAGEOUSLY false statements, in emails, personal communications, on social media, and in news reports.

8) The Endicott Village Attorney wrote a long letter to NYSDEC Feb 6th, and said the process was not legal.

FRIDAY and MONDAY BLAST!
CALL THE ATTORNEY GENERAL'S OFFICE ALL DAY!
Mention any of these points.

The AG's office are the GOOD GUYS.
PLEASE be nice to them.
Politely ask them for an intervention.

Thank you!
Bill Huston
