VERY URGENT REQUEST!!

PLEASE contact The New York State Attorney General's Environmental Protection Bureau. (518) 776-2400

Ask them kindly to MAKE AN INTERVENTION in the Endicott Battery Incinerator Permit Proceeding, set to end on Monday at the Village Offices.

1) The DEC Permit is illegal and fraudulent. It GROSSLY violates SEQRA and the rights and dignity of the PEOPLE who live in the Village of Endicott. It CANNOT BE an Unlisted SEQR action, and it MUST BE a Type-1 SEQR due to a change in a zoning impacting > 25 acres. (6 NYCRR §617.4(b)(2)) We DEMAND an Environmental Impact Statement and a Public Hearing, and a PROPERTY GML 239 review!!!

2) We have NO REMEDY while the courts are closed!

3) This REEKS of political corruption. Two village officials were PRESSURED in a series of meetings (2/28/2020, 3/10/2020) with Fred Akshar, Donna Lupardo, Chris Pelto, Sungeel and their hired attorney and engineers, Jason Garnar, and a heavy presence with reps from Governor Andrew Cuomo's Empire State Development Corp, which made an overt threat: APPROVE THIS or else put these other development projects in jeopardy.

THIS IS MAFIA STYLE BULLYING & INFLUENCE PEDDLING!

THIS LOOKS LIKE ORGANIZED CRIME TO ME!

This looks like a CONSPIRACY of Government Officials, State Actors
acting under Color of Law, to VIOLATE the CIVIL LAWS of the State of NY,
and the Village of Endicott, and create a general Hazard to Public Safety
and Public Health.

We have one of the meetings on tape, where an overt threat came from

Empire State Development Corp. reps.

4) And this is being SHOVED DOWN OUR THROATS during a 100 year Pandemic / Martial Law.

5) We have a winning case, and are prepared to sue the State of NY.
   The AG will have to defend this clusterfr#ck.

    If this goes through, this will be a huge embarrassment to the Governor and

    everyone involved.

6) There is a substantial group of community leaders and ordinary citizens who formed No Burn Broome. Our petition has been online for around 4 days, and has over 1,400 signatures.

We ARE NOT STOPPING until this project is PAUSED, and we get an ENVIRONMENTAL IMPACT STATEMENT and a proper DEC PUBLIC HEARING, customary for a Type-1 SEQR review, which is REQUIRED BY LAW, due to a zoning change greater than 25 acres (560 acres). 

7) The Mayor is continuously making OUTRAGEOUSLY false statements, in emails, personal communications, on social media, and in news reports.

8) The Endicott Village Attorney wrote a long letter to NYSDEC Feb 6th, and said the process was not legal.

FRIDAY and MONDAY BLAST!

CALL THE ATTORNEY GENERAL'S OFFICE ALL DAY!

Mention any of these points.

The AG's office are the GOOD GUYS.

PLEASE be nice to them.

Politely ask them for an intervention.
