This is really looking bad for you all.
We have thousands of people engaged on
this issue. I've never seen anything like this
level of community involvement from this little village in 20 years of living here.
Wait until you see the press conference tomorrow!

DUE TO A REQUIRED ZONING CHANGE
affecting > 25 acres.
This almost certainly guarantees us
a) DEC Public Hearings and b) an EIS
MANY LAWS were violated here.
Several village officials are acting in a very bizarre fashion,
including the Village Attorney.

OUTRAGEOUS false statements to the press, and to the public in emails and on social media:

I know the AG is looking into this.
I believe someone is reaching out to the
Federal Prosecutor based at NDNY.
Everyone knows where this investigation will lead. ESD and the Governor's Mansion.
Our BASIC DEMANDS has been from the beginning
1) A comprehensive EIS, including an economic study, traffic study, road use agreement, health study,
2) COMPREHENSIVE BASELINE Ambient Air Study
3) A full Type-1 SEQR as is required by law due to a required zoning change > 25 acres.
4) Multiple DEC public hearings at every stage (Scoping, DEIS, FEIS, Permit).
5) FOLLOW THE DAMN LAW!
If you do not agree to FOLLOWING NEW YORK
ENVIRONMENTAL CONSERVATION LAW and
ENDICOTT VILLAGE LOCAL LAWS,
then you should have a LOT of money set aside
for the legal fight. Because there are multiple
lawsuits coming.
You should have a LOT of money set aside for Public Relations,
because you have a PR Disaster on your hands.

You have got to be kidding me.
get the giggles! This is so ridiculous.
Your position is untenable.
You cannot win here.
I have been involved in many environmental campaigns, and many winning campaigns: Constitution Pipeline, LPG storage at Seneca Lake, Fracking in NY, and others.
We have defeated billion-dollar projects from companies with hundreds of billions in market cap.
I have almost never seen a defeat where there is
strong community engagement, like we have here.
There is a Nonviolent Direct Action Group forming, which has had very constructive conversations with Endicott Police Chief Pat Garey about the rules of engagement for First Amendment Actions, which may include (at some point) arrestable actions.
We are FIERCE environmental fighters here in NY.
Let's recall We Are Seneca Lake from just a few years ago: where 600 people were arrested doing blockades of an industrial facility ...until they withdrew their application.
Let's recall "My Name is Allegany County" from the 1990 where a small, rural community defeated a low-level nuclear
waste dump.
People here in the Binghamton-area defeated a toxic trash incinerator in the 1980s.
Please be smart and withdraw your application now.
Please consider another location for your Toxic
Hazardous Waste Incinerator.
