"It's not an incinerator!!!"

 

I get emails and comments often from people who

loudly and proudly assert, regarding the proposed

SMCC "Battery Recycling Facility" in Endicott, that it is

"NOT AN INCINERATOR!".

("Universal Waste" is classified as Hazardous by definition)

6. Letter from Thomas J. Fucillo, Esq, an attorney for Barclay Damon, hired by Sungeel, is a gold mine of admissions, including that the the RK Furnace would be regulated under 6 NYCRR Part 374 "Hazardous waste burned in boilers and industrial furnaces" but is "conditionally exempt" pursuant to 6 NYCRR 374-1.8(a)(3). Also, that it would be regulated as an NY Hazardous Waste TSDF, but that these regulations are "onerous", and Sungeel would jump throught hoops to AVOID REGULATION as such, i.e., placing the facility in two buildings instead of one, and that it would create a fictitious business unit if necessary.

   that "electrolytes are incinerated".

Note: $3250 is just for MY BASIC NEEDS! This does not include any budget for my program expenses. For example, part of my work involves doing FOILs/FOIAs, and if agencies don't respond, these sometimes require a lawsuit. I have several lawsuits that I need to file, and each one requires a minimum budget of about $300, and that's if I file pro se (no attorney).

I know everybody is hurting right now due to the lockdowns… but I've worked in the public interest for around 20 years. In the 2000s I was doing a lot of media reform and anti-war work. In the 2010s I've focused on environmental and public safety work.

Here are the current projects I have been working on this year:

• Fighting the Endicott Incinerator. I was a co-founder of the group No Burn Broome. I invited and recruited Dr Paul Connett to be a part of it. I also was the one that located the attorney for the group, Claudia Braymer. I have made around 60 videos about the incinerator, dozens of hours. I started at doing education work about the incinerator 6 months prior to the group No Burn Broome existing! I was the first person who actually used the word INCINERATOR when everybody else was calling at a "recycling facility".

• 5G : I'm part of a New York statewide leadership team fighting 5G. My efforts have been successful so far at derailing a vote on the TERRIBLE Verizon Master License Agreement TWICE! I located a wonderful attorney named Odette Wilkins, who is helping us out PRO BONO(!!) in making sure that we get an agreement that is protective of our rights.

• Peak Oil: I have recently been working on research and education around Peak Oil. This is a global existential threat to humanity of immense proportions. Global oil production in fact peaked November 2018 and has now entered a state of terminal decline. This is a BIG PROBLEM because demand for oil is still on the rise (except for the "conveniently times" pandemic).

I BELIEVE THIS PROBLEM IS 10,000x  WORSE than the Big Scary Mutant Death Plague Virus.

• COVID: this pandemic (or whatever it is) and the consequent lockdowns have impacted the lives of all 7.7B people on planet Earth. I've done extensive research on COVID and I have come to believe the following:

• • There does seem to be some form of severe ARDS or Upper Respiratory, flu-like illness with pneumonia going around, but I put the introduction date as early as Feb 2019, nearly one full year prior to the official beginning in December 2019.

• • There's much about this COVID official narrative that is highly suspect:

• • No causative virus has ever been isolated.

• • NO CAUSATIVE AGENT WHATSOEVER has been properly identified, using a standard Epidemiological Method which has been used for the last 100 years

• • Koch's Postulates have not been satisfied.

• • There was no examination of alternative hypotheses as required, including the examination of air pollution and RF radiation (5G/WiFi/Cell phones/Smart Meters), which are both known to cause ARDS-type symptoms.

• • There is no accurate serological test for COVID-19. The most prevalent test being used is the Polymerase Chain Reaction.

• • But there's a problem: PCR it's not a diagnostic test! PCR is completely unsuitable for use as a  diagnostic test! This comes from Kary Mullis, who won the Nobel Prize for inventing PCR. So he should know.

• • Christian Drosten's COVID specific PCR was made without access to viral isolates!!! This is like building an elephant detector without access to a real elephant with which to calibrate the device.

• • There are similar problems with the antibody antigen test.

• Probably the highlight of my COVID research was a FOIL request that I made to the New York State Department of Health. I asked them to provide me all their data on two subject areas:

1. 1. Safety data relating to asymptomatic or healthy people chronically wearing masks, and

   2. any data on the efficacy of masks that stopping the spread of infectious disease.

The New York State Department of Health responded and said they had no records which matched my request!!

For this work, I was dragged through the courts for 2 years, and stalked, followed, and surveilled by industry goons in 2 states.

HOW MUCH of your home values were saved by the defeat of the Sungeel Incinerator?

After No Burn Broome was created, certain others grabbed the spotlight, and I was basically pushed out of the main organizing group. While these certain others were experts in PFAS and the chemistry, I was the main expert in SEQR and the NY environmental laws.

We ALMOST lost the fight, because the so-called leaders were driving us into a direction which would be solved by PERMIT CONDITIONS, and not by defeating the damn thing.

But let me remind everyone that I WAS THE ONE WHO TOLD YOU ALL THAT AN INCINERATOR WAS COMING TO ENDICOTT, while the news media, and ALL of the local politicians were calling it a "Recycling Facility"!

I estimate I saved MILLIONS of dollars in home values, which would have become worthless with a Hazardous Waste Incinerator down the street.

If I could get a $100 donation from 50 Endicott residents, my rent problems would be solved!

Besides the back rent, I have other obligations. I also need a small budget so that I can survive until my social security comes through.

Realistically, I need to raise $7,000 to $10,000.
This is for my basic survival.

On March 30th, Gov. Cuomo's DEC issued an Air State Facility Permit for Sungeel MCC Americas proposed Battery Incinerator in downtown Endicott, during a pandemic, and while everyone is home under curfew.

Bloody hell, what's the rush?

DEC assured us in the SEQRA "Negative Declaration", that there is "no identified creation of a hazard to human health", despite that at least 3 known carcinogens will be emitted.

DEC also told us, "The proposed action is consistent with local planning and zoning requirements. There is no identified creation of a material conflict with local land use plans", despite that a Hazardous Waste Incinerator is not a permitted land use in the Village according to local laws.

The applicant never approached the planning board, and never even obtained a building permit!

We were granted NO public hearing, and NO protections as an Environmental Justice Community.

The DEC has kept the community in the dark, and worked more as a project co-sponsor rather than a steward for the environment.

Ordinarily, there is a 30 day window to appeal with an Article 78 lawsuit, but all of the courts are closed to non-essential filings. So this facility will get constructed, and there is NO RIGHT TO REMEDY.

Nice going, Governor.

Summary of DEC errors in the various permit docs:

• The DEC claimed in the Notice of Completed Application 10/19/2019 this was an Unlisted Action. This MUST BE a Type I action (not unlisted) by 6 NYCRR 617.4 §(2),§(3),§(7), and §(10)!
• The DEC claimed 10/19/2019 that the Coordinated Review was complete. (the village just ordered it Monday 4/6.)
  
• The DEC claimed in the Negative Declaration 10/19/2019,
  
  8. The proposed action is consistent with local planning and zoning requirements.
  There is no identified creation of a material conflict with local land use plans.
  
  9. There will be no known impairment of the character or quality of important
  ... aesthetic resources, or of existing community and neighborhood character.

 there was no material conflict with zoning or land use. (the village just begun to change the zoning 4/6).

Joseph Dlugolenski, Scott E. Sheeley, Reginald Parker, and Basil Seggos of the NYSDEC stated in the Notice of Completed Application, the SEQRA Negative Declaration, and the permit itself, seem to have violated NY Penal Law - PEN § 175.40 Issuing a false certificate, a Class E Felony!


New York Consolidated Laws, Penal Law - PEN § 175.40 Issuing a false certificate

A person is guilty of issuing a false certificate when, being a public servant authorized by law to make or issue official certificates or other official written instruments, and with intent to defraud, deceive or injure another person, he issues such an instrument, or makes the same with intent that it be issued, knowing that it contains a false statement or false information.

Issuing a false certificate is a class E felony.

New York Consolidated Laws, Penal Law - PEN § 70.00 Sentence of imprisonment for felony

2. Maximum term of sentence. The maximum term of an indeterminate sentence shall be at least three years and the term shall be fixed as follows:
(e) For a class E felony, the term shall be fixed by the court, and shall not exceed four years.

3. Minimum period of imprisonment. The minimum period of imprisonment under an indeterminate sentence shall be at least one year and shall be fixed as follows: (b) For any other felony, the minimum period shall be fixed by the court and specified in the sentence and shall be not less than one year nor more than one-third of the maximum term imposed.

Here are the various terms of how the Applicant, the DEC, and the EPA classify this facility.	An incinerator is a PROHIBITED LAND USE under existing zoning! Joseph Dluglolenski and Scott E. Sheeley of the NYSDEC seem to have violatedPenal Law - PEN § 175.40 Issuing a false certificate, a Class E Felony!	Zoning and Environmental Laws are Police Powers!

Let's look at the Negative Declaration....	There are several FALSE STATEMENTS here. 8: is consistent with zoning and local land use. 9: No known impairment of asthetic resources, or of existing community and neighborhood character. 11: No identified hazard to human health.
